Non-Circumvention &
Data Protection Addendum

Effective Date: November 24, 2025

This Addendum supplements the SkillUpWork User Agreement and Terms of Service.

1. Non-Circumvention

Users agree not to:

  • Offer or accept payments outside SkillUpWork for projects found on the platform
  • Share direct contact details before a contract is officially started
  • Solicit users to move off-platform
  • Intentionally reduce or avoid platform fees

Violations may result in account suspension, permanent ban, penalty fees, and legal action.

2. Confidentiality

Users must not share or misuse:

  • Business data, personal data, chat logs
  • Designs, code, documents, or proprietary material

3. Data Protection Responsibilities

Users must comply with GDPR, Indian IT Act, SPDI Rules, and DPDP Act 2023.
Freelancers handling Client data must store it securely, restrict access, and delete it after project completion.

4. Security Obligations

SkillUpWork uses HTTPS, encrypted databases, and regular audits.
Users must use strong passwords, updated devices, and safe transfer methods.

5. Breach of Confidentiality

Any misuse or unauthorized sharing may lead to immediate termination, project removal, and legal action.
